It is recommended City Council grant conditional approval of Renaissance Zone Case M-103 by Bradley Shimfessel for a five-year property tax exemption including improvements. Advances to the State for their conditional approval.

CONSIDER BIDS AND AWARD CONTRACT FOR CONTINUOUS FRICTION MEASURING EQUIPMENT (CFME)

RECOMMENDED ACTION

  1. It is recommended City Council authorize City staff to accept lowest compliant bid from Halliday Technologies for the Continuous Friction Measuring Equipment (CFME) and associated attachments which opened on April 24, 2023; and
  2. Approval to apply for funding, accept if awarded, and have the Mayor, City Attorney and the Airport Director sign contracts, grants, and necessary documents.

APPROVE THE CONTRACT WITH THE ND OFFICE OF STATE TAX COMMISSIONER FOR COLLECTION OF CITY SALES TAX

RECOMMENDED ACTION

It is recommended City Council approve the contract with the State Tax Commissioner for the collection of City sales tax for the period July 1, 2023-June 30, 2025 and authorize the Finance Director to sign the contract.

JOINT POWERS AGREEMENT WITH DAKOTA COLLEGE AT BOTTINEAU FOR FUNDING OF IMPROVEMENTS TO THE CTE

  1. It is recommended City Council approve the JPA with Dakota College at Bottineau relating to the additional $1,842,093 funding to be provided to the CTE project;
  2. Approve the corresponding budget amendment to appropriate the funds; and
  3. Authorize the Mayor to sign the agreements.

APPROVE BUDGET AMENDMENT FOR MACA FUNDING REQUEST

RECOMMENDED ACTION

It is recommended City Council approve the budget amendment on first reading for the MACA Carnegie Center funding request of $58,728 and approve the use of Sales Tax Improvements cash reserves.

APPROVE 2020 ROUND 2 STRUCTURE DEMOLITION FINAL PAYMENT

It is recommended City Council approve the final payment to HSG Park Joint Ventures, LLC in the amount of $15,015.60 for the 2020 Round 2 Structure Demolition project.

8.3.

CONSIDER RFPS FOR LEASE OR SALE OF CITY-OWNED RENAISSANCE AND CENTRAL PARKING RAMPS

RECOMMENDED ACTION

Staff seeks guidance from the City Council to consider advertising Request For Proposals (RFPs) for enhanced development of parking ramps property and associated air rights located at 205 1st Street SW and 5 1st Street SW known as Renaissance/City Hall and Central Garages. Renaissance ramp may present use issues the Central ramp does not.

ALCOHOL ORDINANCE REWRITE

RECOMMENDED ACTION

  1. It is recommended City Council retain Swanson & Warcup, Ltd. to assist the City with a comprehensive review and rewrite of its alcohol ordinances; 
  2. Authorize City staff to negotiate a contract; and 
  3. Authorize the Mayor to sign the contract.

CONTRACT NEGOTIATIONS FOR CITY MANAGER

The City Council may discuss or provide City staff with negotiating instructions regarding the City Manager's contract.

8.5.i.

EXECUTIVE SESSION: CITY MANAGER CONTRACT NEGOTIATION

The topic of discussion will be the City Manager’s Contract. The City Council may hold an executive session to discuss negotiating strategy or provide negotiating instructions regarding the City Manager’s Contract if an open meeting would have an adverse fiscal effect on the bargaining strategy and litigating position of the City. See N.D.C.C. 44-04-19.1(9), and N.D.C.C. 44-04-19.2.
